The Legal Framework to address “Fake News”: Possible Policy Actions at the EU Level

Online intermediaries and platforms have adopted a regulatory framework that shielded them from responsibility for editorial control and misconduct by users. This has caused a flow of online news subject to limited fact and originality-checking. In this analysis, Andrea Renda of the College of Europe argues that the policy initiatives by the European Commission are incomplete and that policy responses should include a proactive media policy oriented towards “exposure” and pluralism; a plan to promote media literacy and end user empowerment; and an innovative approach to solutions to “deep fakes”.
